These terms cover your use of gourmetseed.com, its garden guides and its online store, which are run by Gourmet Seed ("we", "us", "our"). By using the site or placing an order, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.

1. Who can buy

To place an order you must be an adult under the law of your state and have a shipping address in the United States. We ship only within the United States for now. You agree that the details you give us are true and complete, and you are responsible for keeping your account sign-in private.

2. Orders

A product listing is an invitation to order, not a promise that an item is available. When you place an order, you are offering to buy. The order confirmation email tells you we received your order; it is not our acceptance. We accept your order when we confirm that it has shipped.

We may decline or cancel an order, or part of one, before it ships: for example, if an item is out of stock, a price or description is wrong, an address cannot be delivered to, or the order looks fraudulent. If we cancel after you have paid, we refund you in full to your original payment method.

3. Prices, payment and errors

Prices are in US dollars. Sales tax and shipping are added at checkout and shown before you pay. Prices can change at any time, but a change does not affect an order we have already accepted.

We accept the payment methods shown at checkout, processed by Shopify Payments, including Shop Pay. By paying, you confirm you are allowed to use that payment method.

We work to keep prices and descriptions correct, but mistakes happen. If we find an error in the price or description of something you ordered, we will contact you before it ships and let you choose to go ahead at the correct price or cancel for a full refund.

4. How orders are filled

Gourmet Seed is the seller of every item in our shop, and your order is with us. Each item is shipped directly from a US warehouse by the brand or distributor named on its product page. An order with items from more than one supplier arrives in more than one package, and a box or packing slip may carry the supplier's name. For any question about your order, email us rather than the supplier, and we will handle it.

5. Shipping

Shipping rates appear at checkout. Delivery dates are estimates, not guarantees, and carriers can be delayed by weather or other events outside our control. Our Shipping Policy has the details. If a package is lost or arrives damaged, email us with your order number and we will help resolve it.

6. Returns and refunds

Returns, refunds and replacements for damaged, defective or wrong items are covered by our Refund Policy. Terms stated on a product page apply to that product.

7. Product information and gardening results

Product descriptions, photos, sizes and specifications come from the brands that make them and can change. Colors on screen can differ from the real item.

Gardening results depend on things no seller controls, including your climate, soil, weather, timing and care. We do not guarantee that any plant will sprout, grow, produce a harvest or survive, or that a product will give a particular result in your garden. Follow each product's label and instructions.

Any warranty on a product comes from its maker, as stated on the product page or packaging. Apart from that warranty and our Refund Policy, and to the extent the law allows, products are sold as described without other promises.

8. Our guides and links to other sites

Our garden guides give general information to help you plan and grow. They are not a substitute for advice from your local extension service or a professional about your own garden. Planting dates and advice vary by region and season.

Our guides link to other websites, and some of those links are affiliate links: if you buy through one, we may earn a commission at no extra cost to you. A purchase on another site is between you and that site, under its own terms, prices and policies. We are not responsible for other sites' content, products or service.

9. Our content

The text, photos, graphics, guides and design of this site belong to Gourmet Seed or to those who license them to us, and are protected by copyright and trademark law. You may read, print and share links to our pages for your own non-commercial use. You may not copy, republish or sell our content, or use automated tools to scrape it, without our written permission. Product names and logos belong to their makers.

10. Comments, reviews and things you send us

If you post a comment or review, or send us photos, questions or ideas, you keep ownership of what you send. You give us a free, ongoing, worldwide permission to use, show, edit for length and share it on our site and in our store. Please only send content you have the right to share.

Do not post anything unlawful, misleading, hateful, harassing or obscene, anything that infringes someone else's rights, other people's personal information, spam or advertising, or links meant to promote another business. We may edit or remove any content at our discretion and are not responsible for what others post.

11. Using the site fairly

Do not use the site to break the law, commit fraud, place orders you do not intend to pay for, interfere with the site's security or operation, or try to reach parts of it you are not allowed to. We may suspend or end access for anyone who breaks these terms.

12. Our store platform

Our store runs on Shopify, and payments are processed by Shopify Payments. Shopify's own terms apply to its services, including Shop Pay if you use it.

13. Disclaimer

We work to keep the site accurate and available, but we provide it "as is" and "as available". To the extent the law allows, we do not promise that the site will be uninterrupted or error-free, or that guide content is complete or current for your location.

14. Limitation of liability

To the fullest extent the law allows, Gourmet Seed is not liable for any indirect, incidental, special or consequential losses, including lost crops, lost profits or lost data, arising from your use of the site or any product. Our total liability for any claim about an order is limited to the amount you paid for that order. Nothing in these terms limits liability that the law does not allow to be limited, or takes away rights you have under your state's consumer protection laws.

15. Indemnity

If someone brings a claim against us because you broke these terms or the law, or because of content you posted, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.

16. Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict of law rules. If you have a problem, please email us first at hello@gourmetseed.com and give us 30 days to try to resolve it. If we cannot, any claim must be brought in the state or federal courts located in Texas, except that either of us may bring a claim in a small claims court that has jurisdiction. This does not take away any right you have to bring a claim where you live under your state's consumer laws.

17. General

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a part of these terms right away, we have not given up the right to enforce it later. These terms, together with the policies they link to, are the whole agreement between you and us about the site. We may transfer our rights under these terms to a new owner of the business.

18. Changes to these terms

We may update these terms from time to time. We will post the new version here and change the "Last updated" date at the top. The terms in place when you place an order apply to that order.
